EverClean, LLC Service Agreement
Indemnification Agreement: By scheduling with EverClean, LLC you agree to indemnify and hold harmless EverClean, LLC and its employees, contractors and affiliates from and against any claims, liabilities, damages, and financial losses arising from and relating to your violation of this service agreement.
General Disclaimer: EverClean, LLC cannot remove all soils, stains or odors from your textiles or hard surfaces. EverClean, LLC cannot improve permanent damage caused by wear including matting, graying or abrading. *EverClean, LLC does not know the complete composition, dye type, prior chemical exposure or level of wear your textiles have been exposed to prior to our cleaning; therefore, we are not liable for damages including dye loss, fiber loss, dye migration, delamination, shrinkage, buckling, tearing, peaking, swelling, cupping or cracking. We clean textiles using detergent and hot water extraction. Your textile manufacturer may not recommend hot water extraction. Dry time may vary. While we take every precaution to care for your home or facility, we are not liable for normal wear and tear including scratches, dents or scuffs.
Privacy Policy: EverClean, LLC shares your contact information with relevant third parties. By scheduling with EverClean, LLC you consent to our sharing your information with relevant third parties. Scheduling and receiving online quotes subscribes you to our email notifications and marketing. You may unsubscribe from our marketing emails at the footer of each email.
CAUTION: Potential Hazards: You give EverClean, LLC permission to bring pressurized water lines containing scalding hot water along with powerful vacuum hoses into your home or facility. You understand that potential damages may occur including water leaks, skin burns or other possible home or health hazards. You and your respective agent(s) agree to indemnify and hold harmless EverClean, LLC from damages, liabilities and costs that could arise from equipment failure at your property.
30-Day Spot-Free Guarantee: The offer is valid for 30 days from the date of service on textiles originally cleaned assuming the 5 question checklist is completed and submitted within 3 days of your service. The customer must notify EverClean, LLC within 3 days of the spot or stain while providing what the substance is and a text image (if we request it). Available only in the Metropolitan Nashville Area: https://maps.app.goo.gl/wwBgmZTbxSAgrGNf6 Exclusions: General soils and wear in traffic areas; permanent stains that require in-depth stain removal: hair dye, bleach, varnish, rust, nail polish, etc.; pet urine odors, pet solids removal (feces, vomit, hair), and subsurface cleaning; improper customer cleaning including soap-saturation and distortion stains, etc.; structural damage. This is a targeted stain removal service, not a complete re-clean.
7-Day Satisfaction Guarantee: EverClean, LLC will reclean textiles in question at no additional cost within 7 days of original textile cleaning. Exclusions include Red Line Items listed on your Pre-inspection Report, textiles effected by the Red Line Items, items noted by the technician as permanently stained or significantly worn or abraded, and textiles with damage, permanent stains, significant wear, distortion and abrasion stains.
Hardwood Cleaning: Prior to service, EverClean, LLC tests for acrylic wax, natural wax/paste, shellac, tung oil and urethane hardwood finishes. We cannot confirm or guarantee what your hardwood floor may contain a particular finish as well as if it is constructed by solid, laminate of fiberboard composition. We are not responsible for removing acrylic or natural floor wax if your floor is found to contain wax during the cleaning regardless if our prior test did not reveal these topical coatings. Our wax removal service does not guarantee complete results. EverClean, LLC is not responsible for hardwood, laminate or vinyl damage including swelling, buckling or loosening of your floor, which could be the result of water seepage between seems, cracked floor finish or fiberboards that may be part of the structure of your hard surface and subfloor.
Hard Surface Polishing or Resurfacing: EverClean, LLC is not responsible for irregularity of newly applied hard floor polish and/or resurfacing finish due to unknown floor finishes below the newly applied polish and/or finish, or objects or inhabitants that may deform the drying floor finish during the drying and hardening period. EverClean, LLC is not responsible for damages that may result from cracked, loosened, or missing floor boards, tile and grout.
Additional Set-up Fee: Most homes or facilities usually require 100 feet of hose or less. Additional hose, van placement or other unusual set-up required may add a nominal fee based on severity.
Online Quote Guarantee: You agree that the information you have entered is accurate including floor/item count and appropriate service level(s) that match the severity of your items to be cleaned. Any significant difference voids the Online Quote Guarantee.
Self-insured In-plant Rug Cleaning Notice: EverClean, LLC self-insures rugs that are damaged at our facility for a total payout of up to $16.25 per square foot regardless if the monetary and/or sentimental value is greater. Any damage less than 100% is prorated by the percent of loss as per a reasonable evaluation between you and our company. If you have a rug of greater monetary or sentimental value, regardless of how the value was ascertained, you agree to our maximum self-insured payout of $16.25 per square foot should the rug become a complete loss while at our physical location.
Invoicing: *All invoices are due at the time of service unless net-30 invoicing is approved by EverClean, LLC. Invoice payments must be received at our business address within 3 business days of your service date including Saturdays. Late or unpaid invoices accrue late fees at 10%. If you do not pay the agreed upon dollar amount or cancel your check and/or credit card transaction, you may be liable for any legal fees and costs associated with the collection of your invoice.
Anti-wicking Stain Protector: Carpet fibers may wick unforeseen stains to the surface as your carpet dries. If you have declined purchasing our anti-wick fiberguard, we are not responsible for stains that may reappear following the cleaning service.
Pet Odors & Urine Stains: Pet urine is an issue of the carpet, pad and sub-floor beneath. Cleaning the surface of carpet will Not remove pet urine odors. Pet odor removal is a separate service that involves locating each urine spot with an ultra violate light or moisture meter and treating the carpet pad and subfloor beneath the carpet using an enzymatic formula. The only way to fully remove all pet urine odors from your floor is to replace the carpet, pad and wood or concrete sub-floor beneath; therefore, we do not guarantee complete pet odor or stain removal. Note: We may not be able to locate all urine spots on polyester carpet if the carpet has been spot cleaned or cleaned in the past.
Subsurface Cleaning: Extracting pet urine and soils from carpet pad may allow liquids to pass through and/or absorb into your subfloor. This could cause damages including cosmetic, structural, electrical or fungal. If you have request subsurface cleaning or treatment, you fully understand and agree that EverClean, LLC is not liable for any damages to your home or facility that might result from our attempting to remediate pet urine and/or subsurface soils from beneath your carpet.
Customer Cancellation: Please let us know as soon as possible if you need to cancel your appointment. There is a $132.00 cancellation fee for non-emergency cancellations if cancelled within 24 hours of the appointment time, including weekends. The $132 is credited back to you if you choose to reschedule with EverClean, LLC within a two weeks of the cancelled appointment. If off hours, please leave your cancellation notice by voice mail or email info@evercleantn.com.
EverClean Cancellation: In the rare event we need cancel your appointment for reasons beyond our control, we will let you know as quickly as possible as well as attempt to find a suitable service provider to fill our cancellation. Abrupt cancellations may occur due to inclement weather, mechanical failure, short noticed employee resignations, software issues or other unforeseen events.
Arrival Time: Our appointment windows include 8 a.m. to 10 a.m., 10 a.m. to 2 p.m., and 12 p.m. to 2 p.m. and 2 p.m. to 4 p.m. CST. You will receive a 30 minute ETA text message prior to our arrival. We do not guarantee to arrive within these window times, but will give you sufficient notice if we’re arriving outside your chosen arrival window.
Adult Supervision Required: All appointments scheduled at a home or facility must have an adult present if children are present.
Bug/Rodent Infestation: We will Not clean textiles in a home or facility that has an obvious and significant bug or rodent infestation: bed bugs, cockroaches, fleas, lice, mice, rats, etc. If your home or facility has an infestation of any sort, please cancel and reschedule when your home or facility has been treated and cleared by a state certified extermination provider.
CAUTION: Slip Hazard: Walking from moist carpet or textiles to hard surfaces creates a slip hazard. Please wipe your feet dry prior to walking from moist carpet or rugs to hard surfaces. We are not responsible for injuries that result from slip hazards.
CAUTION: Tripping Hazard: You understand we will have several hoses, both large and small, running throughout your home or facility during the cleaning service. We are not responsible for injuries that might result from our hoses, equipment or misplaced furniture being in and through walk-ways.
Pictures & Videos: You agree to allow our technicians to take cell phone pictures or videos of soiled, stained or damaged carpet, textiles or hard surfaces for your review on the invoice as a before and after picture or for liability purposes. You further agree we may use the image and/or video for marketing purposes. Each picture or video will not contain items that reveal our customers’ identity including pictures, names, or any other identifiable item, but only a significant amount of the textile we’re cleaning.
Community Property: Whether you own your home or it is a rental property, please provide our cargo van with a sufficient area to park and work from. If you know that our parking location is not be fully located on your property during the service, please contact your home owners association, property management company, landlord, or public service department to gain permission of our being on community property prior to your service.
Moving Furniture: We use carpet coasters to ensure we do not damage the stretch in your carpet or leave a rust or varnish stain after the carpet has been cleaned. We do Not use plastic tabs, foil, foam cubes or any other device to move/block furniture. Though we take every precaution to safely move your furniture, we are not responsible for damages that might result from moving furniture. We do not move certain pieces of furniture including king size beds, two-piece dressers, memory foam mattresses, heirloom furniture, glass/mirrors, antique furniture, furniture of significant value, delicate furniture and any furniture that holds electronics.
Customer Moving Furniture: If you choose to move your furniture, please move it to a hard surface area prior to our arrival. Note: Moving furniture requires you move up to six times during the service: twice during vacuuming, twice during pre-spray and twice during the cleaning.
House Pets: We will be running vacuum hoses from our van into your home, which requires at least one door to be open during service. Please place your pet(s) in a crate, bathroom, or safe location where they will not exit the home through the open door. In the event a pet exits the home, EverClean, LLC is not responsible for lost, injured or deceased pets or their whereabouts during the service.
Traffic Lanes & Black Sole Shoe Stains: Traffic lanes occur for several reasons: fabric wear, black sole shoes, asphalt, pH staining, embedded soils. If you have oil-based carpet and frequently wear black soled shoes as in dress shoes, flip flops, or even house shoes/slippers, know that removing black sole shoe stains is priced as stain removal and we do not guarantee a significant change in appearance. We do not guarantee complete traffic lane soil removal.
Dry Time: There are several contributing factors that affect dry time: level of moisture, level of humidity, air movement and thickness of carpet. Dirtier carpet requires increased water usage, which adds to dry time. Dry time varies based on level of soiling, outside humidity, air movement and thickness of carpet.
Dry Carpet Cleaning: If you choose to our Dry Carpet Cleaning method, you are responsible for thoroughly vacuuming the carpet after it is completely dry. Doing so helps removes additional soils.
Spots & Stains: During our pre-inspection, please be sure to point out all spots and stains that are concerning you. We recommend letting us clean your carpet first to see if the spot(s) comes up with the cleaning. Any spot that remains after cleaning is considered a stain. Stain removal is charged separately.
Service Complaints are Time Sensitive: Any service complaint must be made within 30 days of the original service date. Please review your Pre-inspection Report for a complete understanding of our position on any item(s) marked as Red Line Items.
Service Complaints In and Outside of Nashville, TN: Nashville area service complaints are rescheduled usually within a week. Service complaints outside of the Nashville, Davidson County area are rescheduled within a two week period. A reasonable trip fee may be assessed if your home is more than 30 miles from Nashville, TN.
Hardwood Floor Cleaning and Dustless Refinishing: EverClean, LLC is not responsible for swelling caused by unforeseen cracks in your hardwood finish. EverClean, LLC is not responsible for hardwood floor finish irregularity in the event a person, pet or thing from your home or facility introduces dust, debris, objects or soil particulates to a drying floor finish following our dustless resurfacing service.
Small, Unnoticeable or Hard-to-see Stains: We are not responsible for removing small, unnoticeable stains from your carpet that you have not previously pointed out during pre-inspection. We will attempt to remove unnoticeable stains if you point each one out at a nominal removal rate.
Paint Stains: We are not responsible for removing paint drops that might have occurred from previous paintings. We will attempt to remove paint stains if you point all of them out and we agree on a removal price.
Permanent Stains: We cannot fully remove paint stains, varnish, black shoe sole stains, filtration stains along the baseboards, dyes, inks, rust, burn stains, or any substance that is known cause permanent staining. If we do attempt to remove such stains, we do not guarantee complete removal or satisfaction. Many carpet repair services can remove stains by patching the carpet and moving it to an inconspicuous corner or closet.
Pet and/or Human Hair: Carpet cleaning excludes hair removal. We make no guarantee to remove pet or human hair from your carpet or upholstery. If your carpet has noticeable amounts of pet or human hair, we will charge a fee to attempt to remove as much hair as possible prior to our cleaning.
Red Line Items on Pre-inspection Report: Any item marked as a Red Line Item carries a trip fee equal to one-half our minimum service fee for your location if you request we return to reclean the Red Line Item(s) or the textiles effected by the Red Line Items. Please review your Pre-inspection Report for a detailed explanation for textiles marked as Red Line Items.
Shoe Covers: For safety purposes, we prefer to place floor mats at specific entrances to reduce soiling. Note: We will never walk on freshly cleaned carpet without wearing shoe covers. If you would like for us to wear shoe covers at all times in your home, please let us know prior to our arrival.
Dark Lines at the Baseboard/Door Thresholds: Filtration stains are dark lines around the parameter of your carpet at the baseboard. These are caused by air filtering into the walls at the baseboard typically from gas or electric HVAC heat exchangers. Filtration stain removal is an additional charge.
Wicking (Reappearing Spots): Oil-based carpet can wick, or re-evaporate spots to the surface as the carpet dries. Applying stain protector to the carpet after cleaning reduces wicking. If you do not purchase stain protector, we are not responsible for spots that might return during the drying process.
Personal Items & Items of Value: Prior to our arrival, please have your personal items as well as items of value appropriately stored away.
Personal Property on Carpet: We are a carpet cleaning company – not a maid service. Please have small furniture and personal items such as magazines, clothing, kid’s toys, shoes, etc., off the floor unless you do not want the carpet cleaned beneath such items.
Vacant or Unchaperoned Homes or Facilities: As owner, landlord, tenant or agent of the owner, landlord or tenant, you release EverClean, LLC from service complaints or all claims of damage to your home or facility when you agree to allow our employee’s to be in your home or facility without your presence.
